Free Subscription Terms of Use

These Terms of Use (Terms) govern your free subscription to Ocean Tech Intelligence (OTI, we, us, our), operated by Michael Stephen Woon, ABN 71674238026. They apply to everyone who receives OTI's free content, however you subscribed.
By subscribing to OTI, or by continuing to receive OTI content after these Terms take effect, you agree to these Terms. If you do not agree, you may unsubscribe at any time using the link in any OTI email. These Terms apply in addition to the platform terms and privacy practices of beehiiv, through which OTI is administered.
A free subscription gives you a personal, non-exclusive, non-transferable, revocable licence to access and read the OTI content made available to free subscribers (Content). We decide what Content is available to free subscribers, and we may change that at any time. Some Content is available only to paid subscribers.
The subscription is personal to you and tied to your email address. It is free, and we may change, suspend, or end it, or end free access generally, at any time and without notice.
The Content is for your own personal use. You must not, without our prior written consent:
(a) reproduce, republish, post, transmit, or distribute the Content or any part of it to any other person;
(b) sell, resell, sublicense, or otherwise make the Content available to any third party; or
(c) use the Content in any product or service offered to third parties.
You may briefly quote from or refer to the Content for commentary, criticism, or professional analysis, provided OTI is attributed as the source and you do not reproduce a substantial part of any edition.
All intellectual property rights in the Content belong to OTI and remain with OTI. Nothing in these Terms transfers any of those rights to you. You must not remove or obscure any copyright, trade mark, or other proprietary notice in the Content.
The Content is general intelligence and information only. It is not legal, financial, investment, or other professional advice, and you must not rely on it as such.
We make no representation or warranty as to the accuracy, completeness, currency, or fitness for purpose of the Content. You use and rely on it at your own risk.
To the maximum extent permitted by law, OTI excludes all liability arising from or in connection with the Content or your subscription, including any loss of profit, revenue, data, or business opportunity. Nothing in these Terms excludes any liability that cannot be excluded under applicable law, including under the Australian Consumer Law.
We collect the personal information you provide when you subscribe (such as your email address) and data about how you engage with OTI emails, in order to operate and improve the subscription. This information is administered through beehiiv and is handled in accordance with beehiiv's privacy practices. We do not sell your personal information. You can unsubscribe at any time using the link in any OTI email, which ends your subscription and stops further emails.
You may unsubscribe at any time using the link in any OTI email. We may suspend or end your subscription, or discontinue free access, at any time and for any reason, without notice. Upon you unsubscribing, or upon termination, your licence to access the Content ends.
We may change these Terms from time to time. Where we do, we will give notice by email or within the Content before the changes take effect. Your continued subscription after the effective date of any change means you accept the changed Terms. If you do not agree, you may unsubscribe at any time.
These Terms are governed by the laws of South Australia, Australia. Each party submits to the non-exclusive jurisdiction of the courts of South Australia and any courts competent to hear appeals from those courts.
These Terms, together with beehiiv's applicable platform terms, are the entire agreement between you and OTI about your free subscription. If any provision is held invalid or unenforceable, it will be severed and the rest will continue in force. A delay by OTI in exercising a right is not a waiver of it. You may not assign your rights under these Terms. Notices to OTI must be sent by email to [email protected].
